Punjab for ‘unified command of police’ for tricity


Chandigarh, February 10
The State of Punjab today gave its nod for a “unified command of police” for the Tricity of Chandigarh, Panchkula and Mohali for investigating cases of serious nature, murder and kidnapping included.
In an affidavit placed before the Punjab and Haryana High Court, Punjab Deputy Secretary, Department of Home Affairs and Justice, Om Parkash Bhatia, said the force could comprise police officers from Punjab, Haryana and Chandigarh.
He also suggested that the command or the committee could be of Punjab, Haryana and UT SSPs. The senior-most SSP could be heading it.
The affidavit placed before the Bench of Chief Justice Ranjan Gogoi and Justice Mahesh Grover further suggested that the command could meet once a month on a fixed date. The meeting could be advanced if required by the circumstances.
The affidavit came on a petition filed in public interest for CBI probe into the kidnapping and murder of five-year-old boy Khushpreet. The petition has been filed by the World Human Rights Protection Council through chairperson-cum-advocate Ranjan Lakhanpal.
The petitioner is also demanding a strict action against the errant Chandigarh police officers, allegedly responsible for Khushpreet’s death.
Khushpreet was kidnapped on December 21, 2010, from Burail. He was later found brutally murdered on January 5 in Mohali, hardly at two kilometers from his house. After protests, the Chandigarh administration had ordered magisterial probe. His family has already returned the compensation offered by the UT administration.
Seeking CBI probe in the case, Lakhanpal submitted the police had failed miserably to solve the case. apparently dissatisfied with the probe report, Lakhanpal sought directions to register a criminal case under Section 304-A of IPC on the allegations of culpable homicide not amounting to murder against the errant police officers.
The petitioner also sought directions to the UT administration to come up with a special cell to deal with similar situations and employ specially trained cops.

2 booked for immigration fraud


Mohali, February 8
The police has booked two persons running an immigration company on the charges of duping people of Rs 29.88 lakh on the pretext of sending them abroad. In a complaint to the police, Mukesh Kumar, resident of Nawanshahr, and others said that they had allegedly been cheated by Deepak Arora and Karandeep who were running a company by the name of Jet Immigration in Phase VI here.
They had been promised at the time of payments that they would be sent abroad. But they were not sent and the company had even failed to return their money.
The police has registered a case under Section 420 of the IPC.

NRI panel issues notice to MEA

The Punjab NRI Commission has issued notice to the Union External Affairs Ministry, Ministry of Overseas Indian Affairs and the Punjab government on a complaint filed by expatriate Indian workers regarding non-payment of their salary by Nigerian-based Delta Steel Company for the past 11 months. The NRI Commission has asked them to submit affidavits by March 21 this year.
The bench of the Commission, comprising Chairperson Justice Arvind Kumar (retd), Members VK Bhawra and Jagtar Singh, today issued notice on a complaint filed by Preeti Rajwanshi, who alleged that her father Naveen Kumar Rajvanshi and 117 others had been employed by M/s Global Steel Holding Limited in India and posted to work in Delta Steel Co located in Warry in Nigeria in 2005.
The complaint was annexed with another complaint made by the 117 India expatriate staff of the Delta Steel Company, Nigeria. The complaint had been made to NRI Sabha, Jalandhar, Punjab, that had sent it to the Commissioner, NRI Affairs, Punjab, who in return had forwarded it to the Commission for necessary disposal.
In the complaint, she said there was no provision of medical facilities for such employees and not possible for them to return back to India in absence of payment of their salary and other dues. "They have been kept as bonded labour by the company and there is serious danger to their life and liberty," she alleged.
The Commission ruled that the legal as well as human rights of the employees had been violated. It said it could not remain a mute spectator after receiving a complaint containing such serious allegations. It held that the allegations jeopardised the "Right to Life" enshrined by Article 21 of the Constitution of India, to its citizens.
The Commission also issued notice to Delta Steel Company, Warri, Nigeria, through Ministry of External Affairs and counterpart companies in India of the Delta Steel Company and its chair.

EDMONTON - The Solicitor General of Alberta needs to hire 21 new sheriffs to staff Edmonton courtrooms, the union for provincial sheriffs said Wednesday.
The Alberta Union of Provincial Employees has been urging management at the Edmonton Law Courts to “address the dire shortage of sheriffs,” the union said in a statement.
Derrick Karbashewski, chairman of AUPE Local 003, which represents regulatory and correctional employees, said the issue was discussed in a meeting Oct. 31.
“In order to have a sheriff in every courtroom, they’d have to hire 21 more,” he said. “Management told us in October that they’re working on it, but so far nothing has changed.”
Karbashewski said the shortage is forcing some sheriffs to cancel vacations to cover shifts.
Tuesday, two Court of Queen’s Bench justices took the rare step of publicly criticizing the provincial government for not ensuring courtroom security in Edmonton.
An angry Justice Terry Clackson summoned the news media to his courtroom, pointed out the lack of a sheriff and adjourned his case until one could be found.
“The tragedy is that this system is being held hostage,” Clackson said.
Wednesday morning, Clackson’s courtroom was again without a sheriff, but the justice allowed court proceedings to continue.
There were five criminal courtrooms without sheriffs on Tuesday. On Wednesday, there were seven.
Alberta Justice is responsible for ensuring security at the courthouse, but it is the solicitor general who directly employs the sheriffs.
Premier Alison Redford pledged Wednesday to deal with the issue.
“When I was justice minister, we did seem to have a systemic issue there and I had thought that it had been dealt with,” Redford said. “I’ve asked the solicitor general to look at that. I’m going to make sure we have enough sheriffs and that judges are satisfied.”
Justice Minister Verlyn Olson said he spoke with chief justices Neil Whitman and Gail Vickery on Wednesday and that he has been updated by his department.
“I understand that discussions had been ongoing,” Olson said. “I have to say I was a little surprised by the media frenzy over this yesterday because my department has been working with a committee including Solicitor General and judiciary on some of these issues. Obviously safety in the courtroom is very important to us.”
Olson said discussions are ongoing and he is slated to meet with Associate Chief Justice John Rooke. He declined to say when he expected the security issue would be resolved.
Provincial sheriffs use metal detectors at courthouse entrances, provide general security and are supposed to be present in all criminal and family courtrooms.
There have been no reports of safety incidents due to a lack of sheriffs.

Court overturns California gay marriage ban, appeal planned


SAN FRANCISCO (Reuters) - An appeals court on Tuesday foundCalifornia's gay marriage ban unconstitutional in a case that may lead to a showdown in the Supreme Court.
Supporters of the ban said they would appeal the judgment, calling it "out of step with every other federal appellate and Supreme Court decision." Their appeal is likely to keep gay marriage in the state on hold pending future proceedings.
But the lawyers who won the appeals court round called the decision a milestone, and outside City Hall in San Francisco, a center for gay rights, dozens of same-sex couples hugged and kissed in public, cheering the ruling.
"It means we are included in the American Dream," said Joe Capley-Alfano, who married his husband, Frank, in the summer of 2008, a window of legal same-sex marriage in California.
The majority in the 2-1 decision by the 9th U.S. Circuit Court of Appeals ruled that California's Proposition 8 ban did not further "responsible procreation," which was at the heart of the argument by the ban's supporters.
"Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships as inferior to those of opposite-sex couples," the ruling reads.
But the appeals court did not address whether marriage was a fundamental right available to same-sex couples as well as heterosexuals, focusing instead specifically on Prop 8.
Some lawyers predicted that the narrow ruling would lead the Supreme Court to limit itself to deciding on the California measure or to refusing the case altogether.
Gay rights supporters have traveled a bumpy road since the first legal U.S. gay marriage was conducted in Massachusetts in 2004. Some courts and legislatures have extended those rights, but voters have consistently opposed gay marriage.
California, the most populous state, joined the vast majority of U.S. states in outlawing same-sex marriage in 2008, when voters passed the ban known as Proposition 8.
That socially conservative vote by a state more known for hippies and Hollywood was seen as a watershed by both sides of the so-called culture wars, and two gay couples responded by filing the legal challenge currently making its way through the federal courts.
A federal judge in San Francisco struck down Proposition 8 in 2010, and gay marriage opponents appealed that ruling to the 9th U.S. Circuit Court of Appeals.
Opponents of gay marriage have not decided whether to ask a larger 9th Circuit panel to hear the matter, or appeal directly to the Supreme Court, Andrew Pugno, general counsel for Protect Marriage and a lawyer on the team, said by email.
Court rules allow at least two weeks before a ruling takes effect, so same sex marriages cannot immediately resume in California, court spokesman Dave Madden said.
BROADER QUESTION NOT AT ISSUE
In the ruling, Judge Stephen Reinhardt focused on the unique circumstances of Prop 8 in California, and whether voters had a legally valid reason for passing it.
Backers of Prop 8 had said that it would advance better child-rearing, but Reinhardt said the only effect of the measure was to deny same-sex couples the right to describe their relationship as a "marriage."
"Proposition 8 therefore could not have been enacted to advance California's interest in childrearing or responsible procreation," he wrote, "for it had no effect on the rights of same-sex couples to raise children or on the procreative practices of other couples."
Judge Michael Daly Hawkins joined Reinhardt's opinion, while Judge N. Randy Smith dissented from the main constitutional findings. Hawkins and Reinhardt were appointed by Democrats, and Smith by a Republican.
"The optimal parenting rationale could conceivably be a legitimate governmental interest" for passing the gay marriage ban, wrote Smith. "I cannot conclude that Proposition 8 is 'wholly irrelevant' to any legitimate governmental interests."
Ted Boutrous, a lawyer on the anti-Prop 8 team, said at a news conference that the focus on California's specific circumstances might lead the Supreme Court to avoid the case.
"The way the court wrote the decision will make it that much harder for the proponents to getSupreme Court review," he said.
But Jesse Choper, a University of California, Berkeley, Constitutional law professor disagreed that the ruling would affect whether the high court took the case. However, the Supreme Court justices also might prefer a chance to limit any ruling to California, he said.
About 40 of the 50 U.S. states had outlawed gay marriage before a California state court ruled in 2008 that a ban was unconstitutional, leading to a summer of gay marriages. But California voters that November decided to change the state constitution to limit marriage to a man and woman.
That provoked some gay rights activists to take a matter that had been waged on a state-by-state basis to federal court, essentially staking the entire agenda on one case.
The U.S. Supreme Court is seen as a more conservative body than the lower courts that have been considering the case. Should the high court eventually decide to hear the case, much may depend on Anthony Kennedy, a Republican-appointed justice who has written important pro-gay rights decisions but has not explicitly endorsed gay marriage.
Six states - New York, Massachusetts, Connecticut, Vermont, New Hampshire and Iowa - allow gay marriage, as does Washington, D.C. In addition, about 18,000 same-sex couples married in California during the summer of legalization in 2008, and their unions are valid regardless of the outcome of the Prop 8 case.
New Jersey, Maryland and Washington state are considering legislation to legalize same-sex marriage, and gay rights activists in Maine say they plan to bring the issue to voters in a referendum in that state.

ਰੋਮ (ਇਟਲੀ) 5 ਫਰਵਰੀ - ਜਿਥੇ ਯੂਰਪੀ ਮੁਲਕ ਆਰਥਿਕ ਮੰਦਵਾੜੇ ਦੇ ਪੂਰੀ ਤਰ੍ਹਾਂ ਝੰਬੇ ਹੋਏ ਹਨ, ਉਥੇ ਹੁਣ ਅਰਬ ਦੇਸ਼ਾਂ ਦੇ ਅਤੇ ਏਸ਼ੀਅਨ ਮੂਲ ਦੇ ਪ੍ਰਵਾਸੀ ਕਾਮੇ ਆਪਣੀ ਰੋਜ਼ੀ-ਰੋਟੀ ਦੀ ਭਾਲ ਵਿਚ ਇਨ੍ਹਾਂ ਦੇਸ਼ਾਂ ਵੱਲ ਬਿਨਾਂ ਸੋਚੇ-ਸਮਝੇ ਪ੍ਰਵਾਸ ਕਰ ਰਹੇ ਹਨ। ਗਰੀਸ ਤੋਂ ਬਾਅਦ ਹੁਣ ਯੂਰਪੀ ਮੁਲਕ ਇਟਲੀ ਦੀ ਹਾਲਤ ਬਦ ਤੋਂ ਬਦਤਰ ਹੁੰਦੀ ਨਜ਼ਰ ਆ ਰਹੀ ਹੈ। ਬੇਰੁਜ਼ਗਾਰੀ ਨੇ ਆਪਣੀ ਸਰਦਾਰੀ ਇਟਲੀ 'ਤੇ ਪਹਿਲਾਂ ਹੀ ਕਾਇਮ ਕਰ ਲਈ ਹੈ, ਪਰ ਫਿਰ ਵੀ ਅਰਬ ਤੇ ਹੋਰ ਏਸ਼ੀਆ ਮੁਲਕਾਂ ਦਾ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸ ਲਗਾਤਾਰ ਇਟਲੀ ਵੱਲ ਜਾਰੀ ਹੈ। ਯੂ. ਐਨ. ਓ. ਦੀ ਰਫ਼ਿਊਜ਼ੀ ਏਜੰਸੀ (ਯੂ. ਐਨ. ਐਚ. ਸੀ. ਆਰ.) ਦੀ ਵਿਸ਼ੇਸ਼ ਰਿਪੋਰਟ ਮੁਤਾਬਿਕ ਸਾਲ 2011 ਵਿਚ ਸਮੁੰਦਰੀ ਰਸਤੇ ਰਾਹੀਂ ਯੂਰਪੀ ਮੁਲਕਾਂ ਵਿਚ ਦਾਖਲ ਹੁੰਦੇ ਅਰਬ ਅਤੇ ਏਸ਼ੀਅਨਾਂ ਮੂਲ ਦੇ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸੀ 1500 ਦੇ ਕਰੀਬ ਮੌਤ ਦੇ ਮੂੰਹ ਵਿਚ ਜਾ ਪਏ ਦੱਸੇ ਜਾਂਦੇ ਹਨ। ਅਧਿਕਾਰੀਆਂ ਨੇ ਇਸ ਗੱਲ ਦਾ ਖੁਲਾਸਾ ਟੈਲੀਫੋਨਾਂ ਅਤੇ ਈਮੇਲਾਂ ਅਤੇ ਹੋਰ ਇਲੈਕਟ੍ਰਿਕ ਸਾਧਨਾਂ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਕੀਤੇ ਅੰਕੜਿਆਂ ਦੇ ਆਧਾਰ 'ਤੇ ਕੀਤਾ ਹੈ। ਯੂ. ਐਨ. ਓ. ਨੇ ਯੂਰਪੀ ਦੇਸ਼ਾਂ ਵਿਚ ਦਾਖਲ ਹੋ ਰਹੇ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਲੋਕਾਂ ਦੇ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸ ਨੂੰ ਰੋਕਣ ਲਈ ਅਤੇ ਇਸ ਦੀ ਰੋਕਥਾਮ ਲਈ ਬਣਾਈ ਗਈ ਵਿਸ਼ੇਸ਼ ਏਜੰਸੀ ਦੀ ਸੰਨ 2007 ਵਿਚ ਸਥਾਪਨਾ ਕੀਤੀ ਸੀ। ਜਿਸ ਦੁਆਰਾ ਇਕੱਤਰ ਕੀਤੇ ਗਏ ਅੰਕੜੇ ਮੁਤਾਬਿਕ ਸੰਨ 2007 ਵਿਚ ਸਮੁੰਦਰੀ ਰਸਤੇ ਰਾਹੀਂ 650 ਬੰਦੇ ਮਾਰੇ ਗਏ ਸਨ। ਏਜੰਸੀ ਦੇ ਤਾਜ਼ੇ ਇਕੱਤਰ ਕੀਤੇ ਅੰਕੜਿਆਂ ਮੁਤਾਬਿਕ ਸੰਨ 2008 ਵਿਚ ਸਮੁੰਦਰੀ ਰਸਤੇ ਰਾਹੀਂ ਯੂਰਪੀ ਮੁਲਕਾਂ ਵਿਚ 54 ਹਜ਼ਾਰ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸੀ ਦਾਖਲ ਹੋਏ ਸਨ। 2007 ਤੋਂ ਲੈ ਕੇ ਸੰਨ 2011 ਤੱਕ ਸਭ ਤੋਂ ਵੱਧ ਦਾਖਲੇ ਦੀ ਦਰ ਆਰਥਿਕ ਮੰਦੀ ਦੇ ਬੁਰੀ ਤਰ੍ਹਾਂ ਝੰਬੇ ਪਏ ਯੂਰਪੀ ਦੇਸ਼ ਗਰੀਸ ਅਤੇ ਇਟਲੀ ਵਿਚ ਹੋਈ ਦੱਸੀ ਜਾਂਦੀ ਹੈ। ਏਜੰਸੀ ਦੇ ਅਧਿਕਾਰੀ ਨੇ ਇਕ ਹੋਰ ਸਨਸਨੀਖੇਜ਼ ਪ੍ਰਗਟਾਵਾ ਕਰਦਿਆਂ ਦੱਸਿਆ ਕਿ ਸੰਨ 2011 ਵਿਚ ਯੂਰਪੀ ਦੇਸ਼ ਇਟਲੀ ਵਿਚ ਸਭ ਤੋਂ ਵੱਧ ਗੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸ ਸਮੁੰਦਰੀ ਰਸਤੇ ਰਾਹੀਂ ਹੋਇਆ, ਜਿਸ ਤਹਿਤ 56 ਹਜ਼ਾਰ ਲੋਕ ਇਟਲੀ ਵਿਚ ਦਾਖਲ ਹੋਏ, ਜੋ ਕਿ ਇਕ ਆਪਣੇ-ਆਪ ਵਿਚ ਇਕ ਰਿਕਾਰਡ ਹੈ, ਜਿਨ੍ਹਾਂ ਵਿਚੋਂ 28 ਹਜ਼ਾਰ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਪ੍ਰਵਾਸੀ ਅਰਬ ਦੇਸ਼ ਤੂਨੇਸ਼ਨੀਆ ਦੇ ਸੀ। ਅਧਿਕਾਰੀ ਇਸ ਗੱਲੋਂ ਵੀ ਬਹੁਤ ਹੈਰਾਨ ਹਨ ਕਿ ਐਨੇ ਭਿਆਨਕ ਸਮੁੰਦਰੀ ਤੂਫਾਨਾਂ ਦੇ ਬਾਵਜੂਦ ਲੋਕ ਆਪਣੀ ਜਾਨ ਖਤਰੇ ਵਿਚ ਪਾ ਕੇ ਯੂਰਪੀ ਮੁਲਕਾਂ ਦੀ ਸ਼ਰਨ ਲੈ ਰਹੇ ਹਨ।
